Atlas Grove rolls prior DIP financing into exit facility to pursue over $3 billion in antitrust recoveries following Harvest Sherwood’s chapter 11 plan effective date

Atlas Grove Partners (together with its affiliates and managed funds, “Atlas Grove”) today announced that the chapter 11 plan of reorganization for Harvest Sherwood Food Distributors has gone effective, with Atlas Grove serving as Plan Funder and rolling its previously provided debtor-in-possession (“DIP”) financing into a $180 million exit facility. Since providing the DIP facility in June 2026, Atlas Grove has worked with the Debtors and key stakeholders to resolve outstanding legal matters and help position the Estate for strong recovery efforts.

“We are pleased to support Harvest Sherwood’s confirmed plan and to continue our role as Plan Funder. Harvest is a complex post-confirmation Estate, and Atlas Grove’s platform is purpose-built for situations where legal process, asset recovery and capital solutions intersect,” said R Christian Wyatt, Co-Founder and Managing Partner of Atlas Grove. “Our objective remains straightforward: to work constructively with the litigation trustee, the Estate and its stakeholders to maximize recoveries through a disciplined, legally grounded and commercially practical approach.”

“Atlas Grove applied our experience in bankruptcy and litigation to resolve several complex issues prior to emergence. We are now moving forward with the pursuit of over $3 billion of antitrust recoveries,” said David Proman, Co-Founder and Managing Partner of Atlas Grove. “We appreciate the support of the unsecured creditors’ committee and will continue to work closely with the Estate’s fiduciaries and advisors on the matters ahead.”

Harvest Sherwood was the largest independent wholesale food distributor in the United States before ceasing operations in April 2025 and filing for chapter 11 protection the following month. The Estate’s assets include antitrust litigation claims against more than 25 defendants, primarily in the chicken, pork and beef producer industries.
