Can You Claim Compensation for Damp and Mould if Your Landlord Keeps Ignoring You?

Government health guidance treats damp and mould as a real health risk in rented housing.

Damage to your belongings

If mould has damaged clothes, shoes, bedding, curtains, furniture, children’s items or electrical goods, you may be able to include those losses. Keep photos, receipts where possible, and a list of what was affected. Even if you do not still have every receipt, it is still worth recording the loss clearly.

Loss of enjoyment of your home

You are paying rent for a home you should be able to use properly. If a bedroom becomes unusable, if you have to move furniture away from damp walls, avoid certain rooms, or constantly clean mould just to get by, that reduced enjoyment of the property can matter. In some claims, compensation reflects the fact that part of your home was not properly usable for a period of time.

Yes, because the route you take can vary.

If you rent from a council or housing association in England, Awaab’s Law is now in force for social housing. From 27 October 2025, social landlords must investigate and act on emergency hazards and significant damp and mould hazards within set timeframes. That gives social tenants much clearer expectations where serious damp and mould is reported.

If you rent privately, you still have rights. The Homes (Fitness for Human Habitation) Act applies to private tenants as well as many social tenants, and it helps tenants challenge unsafe or unfit housing conditions, including serious damp and mould where the home is not fit to live in. 

How common is this problem in the UK?

Sadly, damp and mould are not rare problems. The English Housing Survey reported that in 2023, serious condensation affected 3% of homes, with higher rates in social rented housing than in many other tenures. Separate research published by the government in late 2025 found that 77% of private renters reported some kind of issue with their current property, and damp or mould was the most commonly stated issue at 44%.

What should you do if your landlord keeps ignoring you?

Start by reporting the issue in writing if you have not already done so. Be specific. Say where the damp and mould is, when it started, how it is affecting your home, and whether anyone in the household has health issues that may be made worse.

Do not rely only on phone calls. Email is ideal because it creates a record.

2. Gather evidence as the problem continues

Keep photographs, videos, a diary of events, and proof of damaged items.

3. Ask for a proper inspection and repair plan

A quick wipe-down or repaint is not enough if the underlying cause is still there.

4. Escalate the complaint

Depending on your landlord, that might mean the council’s environmental health team, the Housing Ombudsman, or legal advice about a housing disrepair claim. Shelter and Citizens Advice both make clear that tenants can escalate where landlords fail to address serious damp problems.
