TALLAHASSEE, FL, August 27, 2026 /24-7PressRelease/ -- Attorney Carrie Roane of Fasig Brooks Law Offices announced today the filing of a civil lawsuit against OpenAI., on behalf of Reese Gourley, a survivor of the shooting at Florida State University on April 17, 2025. The complaint alleges that the company's conversational Chat GPT product was defectively designed and lacked appropriate safety guardrails, which resulted in Chat GPT causing or contributing to the mass shooting and the subsequent and tragic loss of life and injuries.
Two people were fatally shot that day, with Gourley and five other victims injured as a result of the shooting. Investigations into the shooting revealed the suspected shooter had used Chat GPT on the day of the shooting engaging in "chats" as to what type of handgun and ammunition he should use, what the student union would be most crowded and other disturbing chats that Roane believes should have been a red flag and reported to law enforcement authorities immediately. That no responsible action was taken by OpenAI, which could have prevented the tragedy, prompted today's filing in the Florida Federal Court Northern District.
"The victims of this horrific nightmare and their families would not have suffered if Open AI had properly designed and utilized safeguards in their product, as opposed to rushing it to market to maximize profitability," Roane said. "The victims and their families deserve accountability, at the very least. Filing this suit isn't about punishing innovation — it's about making sure a powerful technology company answers for the role its product played in this tragedy and ensuring that the safety of its consumers and the public is the paramount focus of the company."
The lawsuit seeks damages for negligent product design and requests a jury trial.
