U.S. Attorney Preet Bharara Fails to Appear in New York Post Trademark Case

On November 6, 2014, Attorney Anthony J. Piacentini, wrote a letter to Preet Bharara, U.S. Attorney For Southern District of New York, pointing out his office's behavior in regard to protecting the rights of the 200,000 investment victims of the TowersInvestors.com restitution fraud case. Bharara failed to appear in court on October 31, 2014 on behalf of the victims at a hearing in the New York Post Holding, Inc. VS New Post Publishing, Inc. Trademark case.

The trademark name "New York Post" is an asset that is legally owned by the restitution victims of Mr. Hoffenberg's crime. Because of this, Bharara's action by not appearing in court hurt the 200,000 TowersInvestors.com victims. 

In court, Mr. Hoffenberg provided the Judge with evidence that he is the rightful owner of the trademark because the trademark assignment was signed by an individual who was an employee of the bankrupt New York Post, who has been arrested for financial fraud in the New York Post case.

Bharara's failure to appear also violated the fact that "Congress directed the Attorney General to aggressively enforce the rights of victims." 

Some may argue that Bharara's failure to appear in court can be considered against the Congressional act. 

Sooner more so than later, Bharara must mitigate the above actions and protect the 200,000 TowersInvestors.com investment victims.
