Bergen County Drug Crimes Lawyer Adam M. Lustberg Explains the Complexity of Drug Cases in New Jersey

By: Magic PR

Bergen County drug crimes lawyer Adam M. Lustberg (https://www.lustberglaw.com/drug-crimes/) releases a new article explaining the complexity of drug cases in New Jersey. The lawyer mentions that drug crimes usually range from minor to truly severe. However, it is important that someone have the proper legal representation regardless of the level of the offense they are being charged with.

“A drug case can be very complex and can lead to some very serious penalties if you are convicted. Federal and state law enforcement, as well as their respective prosecuting agencies, take these crimes very seriously and you need an experienced attorney on your side as soon as possible,” says the Bergen County drug crimes lawyer

The lawyer explains that there are four most common drug charges in New Jersey. These are namely the Possession of a Controlled Dangerous Substance, Possession with Intent to Distribute, Distribution, and Possession of Drug Paraphernalia. The severity of the penalties will usually be dependent on the type of drugs and the amount that the person is alleged to have.

Attorney Adam Lustberg says that the penalty for possession of fewer than 50 grams of marijuana can be up to 6 months in jail, a $1000 fine, and suspension of a person’s driver’s license. It is also considered a disorderly persons offense. For possession of more than 50 grams of marijuana, the penalties can be up to 18 months in prison, and a fine of up to $15,000.

In the article, the lawyer also enumerates the other penalties. Possession of narcotics or controlled dangerous substances can also carry three to five years in prison and a fine of $1,000 to $25,000. For those with the intent to distribute, the charges can be up to 18 months and a $15,000 fine.

“For heroin or cocaine, a first, second, or third-degree charge can be filed. For example, less than ½ an ounce is a third-degree crime, while more than five ounces is a first-degree crime. The third-degree charge can include up to 5 years in prison and a fine of up to $75,000, while the first-degree crime carries up to 20 years in prison and a fine of up to $500,000,” the drug crime lawyer adds.

Furthermore, attorney Lustberg says that the court might also consider other sentencing alternatives that may include special probationary periods where the offender goes through a rehabilitation program. An assessment will be done by a professional to see if the offender would benefit from drug and alcohol treatment based on their dependence. It is appropriate when an offender was under the influence of alcohol or attempted to acquire drugs or alcohol.

Lastly, attorney Adam emphasizes the importance of having a skilled lawyer when facing drug charges. Having an experienced criminal defense lawyer may be able to help the client understand their rights and protect their freedom.
