On October 23, 2003, First Data Corporation issued a press release indicating that it had been notified that the U.S. Department of Justice intends to file a lawsuit challenging the proposed merger involving First Data Corporation and Concord EFS, Inc. A copy of the press release is attached hereto as Exhibit 99.
